1. Acceptance of Terms

By downloading, installing, or using the Pann app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and the service provider.

The service provider is an individual entrepreneur operating under Swiss law (Einzelunternehmen, brand: Fritz Tech).

3. Description of Service

Pann is an AI cooking assistant that provides:

• Recipes built around one to three ingredients you name, by text or a photo, quietly sized to your goal
• An assistant that plans your week and turns plans into a shopping list
• Voice-guided cooking with technique tips for the pans you actually own
• Rescue help when a cook goes wrong
• A recipe library that syncs across your devices

The App uses AI vision and language models to recognize ingredients and generate cooking guidance. All content is generated automatically.

4. Subscription & Payments

• All payments are processed through the Apple App Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the period
• Manage or cancel your subscription in your Apple ID account settings
• Refunds are handled according to Apple's refund policy
• Prices may vary by region and are displayed in your local currency
• Free-trial periods convert to paid subscriptions automatically unless cancelled

5. AI-Generated Content Disclaimer

Important: all recipes, steps, and advice provided by Pann are generated by AI. By using the App, you acknowledge that:

• AI can make mistakes, provide incorrect information, or give inappropriate advice
• Instructions may not be suitable for your specific situation, skill level, or equipment
• The AI cannot assess real-world hazards or your personal capabilities
• You must independently verify all instructions before cooking
• AI-generated content does not replace professional culinary or medical expertise
• The accuracy of AI analysis depends on the quality of information you provide

6. User Responsibilities

By using Pann, you accept full responsibility for:

• Assessing whether a recipe is within your skill level
• Verifying AI-generated instructions against reliable sources
• Using appropriate kitchen safety (knife handling, hot pans, oil temperatures)
• Knowing when to stop and consult a qualified professional
• Any damage, injury, or other consequences resulting from your use of the App
• Complying with local food-safety regulations
• Ensuring you have the ingredients you need before starting a recipe

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind
• The service provider is NOT liable for direct, indirect, incidental, special, consequential, or punitive damages
• The service provider is NOT responsible for personal injury, property damage, or financial loss
• The service provider is NOT liable for any actions you take based on AI-generated content
• Total liability is limited to the subscription fees you paid in the 12 months preceding the claim

You use this app entirely at your own risk.

8. Indemnification

You agree to indemnify, defend, and hold harmless Levin Fritz from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, any cooking you do based on App content, your violation of these Terms, or any content you submit.

9. Medical & Dietary Exclusions

Pann is NOT a substitute for medical or professional dietary advice and should NOT be relied on for:

• Severe food allergies (nut, shellfish, gluten-related medical conditions)
• Medical-grade dietary protocols (diabetes, renal disease, eating disorders)
• Infant or baby food preparation
• Food safety for high-risk groups (pregnant, immunocompromised, elderly)
• Commercial food preparation or restaurant use
• Any preparation involving raw or undercooked animal products without proper food-safety training

Pann is for everyday home cooking. For specialized dietary needs, consult a qualified medical professional or dietitian before relying on AI-generated recipes.

10. Account & Termination

• You are responsible for maintaining the confidentiality of your account
• The service provider may suspend or terminate accounts that violate these Terms
• You can delete your account at any time in Settings
• Upon termination, your right to use the App ceases immediately

11. Intellectual Property

All content, features, and functionality of the App are owned by Levin Fritz and are protected by Swiss and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

12. Changes to Terms

The service provider reserves the right to modify these Terms at any time. Significant changes will be communicated through the App. Your continued use of the App constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of St. Gallen, Switzerland.
